Terms of Service
These Terms of Service ("Terms") govern your access to and use of ClaimDrive ("Service"), operated by ClaimDrive ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
ClaimDrive is a SaaS platform designed for roofing companies to:
- Monitor insurance claim email threads via Gmail integration
- Automatically follow up on stalled insurance claims
- Summarize and classify inbound emails using artificial intelligence
- Alert sales representatives when human action is required
- Optionally send SMS status updates to homeowners
- Provide dashboards for administrators and sales representatives
2. Account Registration
To use ClaimDrive, your company administrator must create an account and invite team members. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
ClaimDrive uses Supabase for authentication. We never collect or store your Gmail password. Gmail access is authorized exclusively through Google's OAuth 2.0 protocol.
3. Gmail Integration and Authorization
By connecting your Gmail account to ClaimDrive, you authorize us to:
- Read emails that carry the "ClaimDrive" label in your Gmail account (scope:
gmail.readonly) - Create and manage the "ClaimDrive" label (scope:
gmail.labels) - Send emails and create drafts on your behalf for automated follow-ups and AI-suggested replies, and register push notifications for the ClaimDrive label (scope:
gmail.modify) - Create and manage Gmail filters that automatically apply the "ClaimDrive" label to incoming and outgoing emails matching your configured domains (scope:
gmail.settings.basic)
You may revoke Gmail access at any time by disconnecting your mailbox in the ClaimDrive dashboard or removing ClaimDrive from your Google Account permissions. Revoking access will stop all email monitoring and automated actions for your mailbox.
4. Email Labelling and Filtering
As part of the onboarding process, ClaimDrive may automatically:
- Create a Gmail label called "ClaimDrive" in your connected account
- Create Gmail filters based on email domains configured by your company administrator or by you
These filters automatically apply the "ClaimDrive" label to:
- Incoming emails from configured domains (e.g., emails received from @statefarm.com), with built-in exclusions for newsletters, promotional, and spam-like content
- Outgoing emails you send to configured domains (e.g., emails you send to @statefarm.com)
These labels and filters are created within your Gmail account and remain under your control. You may modify or remove them at any time through your Gmail settings. ClaimDrive will recreate missing or modified filters on the next sync to maintain the intended labelling behavior.
5. Automated Actions
ClaimDrive performs the following automated actions on your behalf:
- Follow-up emails: When a claim is stalled (no adjuster response within a configured period), ClaimDrive sends polite follow-up emails in the existing email thread using the assigned rep's connected mailbox.
- Email drafts: ClaimDrive may create email drafts in a rep's Gmail account with AI-suggested responses for their review before sending.
- SMS notifications: ClaimDrive sends text messages to representatives when action is required on a claim.
- Homeowner SMS updates: If enabled by your company and with homeowner consent, ClaimDrive sends informational status updates via text message.
Automated follow-ups may be paused manually by a representative or automatically by the system when complex issues (denials, legal matters) are detected. Your company administrator can configure follow-up timing and maximum follow-up counts.
6. AI-Generated Content
ClaimDrive uses OpenAI to generate email summaries, classifications, and suggested responses. You acknowledge that:
- AI-generated content is provided as a convenience and may not always be accurate
- You are responsible for reviewing any AI-generated drafts before they are sent
- Automated follow-up emails use pre-approved templates, not AI-generated copy
- ClaimDrive is not liable for decisions made based on AI-generated summaries or classifications
7. SMS Communications
By providing your phone number, you consent to receiving SMS messages from ClaimDrive related to claim activity. Message and data rates may apply.
- Representatives receive SMS alerts when human action is required on a claim and reminders when a reply is overdue.
- Homeowners may receive optional informational status updates if SMS updates are enabled by the company and the homeowner has not opted out.
You may opt out of SMS at any time by replying STOP to any ClaimDrive text message.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to send spam, unsolicited communications, or harassing messages
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service in any way that violates Google's API Services User Data Policy
9. Intellectual Property
The Service, including its design, features, code, and branding, is owned by ClaimDrive and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes in accordance with these Terms.
Your data remains your property. You grant ClaimDrive a limited license to process your data solely to provide the Service.
10. Limitation of Liability
To the maximum extent permitted by applicable law, ClaimDrive shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Damages arising from automated actions (follow-up emails, SMS) sent by the system
- Inaccuracies in AI-generated summaries, classifications, or suggested responses
- Service interruptions due to third-party provider outages (Google, OpenAI, Twilio, Supabase)
Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Termination
Either party may terminate use of the Service at any time. Upon termination:
- All Gmail Watch registrations for connected mailboxes will be cancelled
- Stored OAuth tokens will be revoked and deleted from our database
- All associated claims, messages, homeowner records, and event logs will be deleted
- Automated follow-ups and SMS alerts will cease immediately
We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will notify registered users by email of any material changes. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
